Veterans Disability Benefits in New York

How the VA Disability Program Works
Before applying for VA disability benefits, it helps to understand how the VA disability program works.
The VA uses a rating system to evaluate the medical condition. Each disability receives a percentage from 10% to 100%. A higher percentage indicates a more severe condition, leading to a larger monthly benefit payment.
Veterans usually must undergo a Compensation & Pension (C&P) exam, a medical evaluation conducted by the VA to measure the severity of a veteran's service-related disability.
For veterans with more than one disability, each one is individually rated, then combined into a single disability rating.
Eligibility Requirements for VA Disability Benefits
To qualify for VA benefits, New York veterans must meet several guidelines.
Both of these must be true:
- You have an existing condition, either physical or mental, that impacts your health, and
- Your service history includes active duty, active duty for training, or inactive duty training.
And, at least one of the following must be true:
- You incurred an injury or sickness during your military service that can be connected to your current condition. This is known as an in-service disability claim.

- An existing injury or illness from before your military service worsened due to your service — called a pre-service disability claim, or
- You have a disability that is associated with your active-duty service but it only manifested after your service ended. This is known as a post-service disability claim.
The success of a VA disability claim usually hinges on having medical proof that links your health problems to your time in active service.
Detailed medical records play an important role in showing how your condition developed or worsened while you served. The more complete and comprehensive your evidence is, the better your chances of being awarded VA disability benefits.
How to Apply for VA Disability in New York
Before you apply for disability benefits, make sure to gather your necessary documents and medical evidence. This includes your military records, medical documents, and your DD214 form or other proof of your military separation.

After you have collected your required documents, you're ready to apply. The best way to file a claim is online at VA.gov. Simply click on "Sign in to start your application" and follow the directions provided.
You can also mail your application or visit a VA office and deliver it in person.

The VA's processing times can vary, but it usually takes between 3-6 months to process your claim. To speed up the process, make sure your claim contains complete and accurate information.
Appeal a Denial
If you're a veteran from New York and your VA disability claim is rejected, don't worry — you can appeal the decision. Complete and submit a Notice of Disagreement form within a year from the date you got the denial notice.
